Statement of Facts
- On 16 March 2026 and 24 April and 1 May and 29 May 2026, the following notices, correspondence, invoices, demands, or documents were sent and/or served:
(a) Statement of Defence, Notice of Opposition, Affidavit with Exhibits 1-18 received service on 16/3/26 and 24/4/26 total of 15 documents and 245 pages accepted for service 16 March where proof of receipt either contained in these documents or can be provided with first exhibit documents received by officers ASB BANK in March 2025;
- Appeal Documents being total 29 documents and 326 pages received in 2 parts on 1 and 4 May 2026;
- AFFIDAVIT IN SUPPORT DEMAND FOR FULL DISMISSAL DUE TO MISCARRIAGE OF JUSTICE WITH REPARATION AND REMEDY or MOVE TO FULL TRIAL HEARING WITH ALL LISTED PLAINTIFFS being 9 page affidavit and Exhibits A to E plus Three Witnesses Statement of Facts plus Affidavit Judy Valya Marina dated 28 May and filed 29 May 2026;
- That due to non-rebuttal and evidence provided all respondents and debtors have been found guilty using false identity of person and defendant to claim authority over man and property belonging to man held in private trust using prohibited actions of serfdom and debt bondage to obtain pecuniary gain and cause loss with threats to seize property and take away necessities for life, liberty and security; and
- That the evidence of this is found in High Court Rules part 1, section 1.3 the definition of a defendant is that of a person where a person is very clearly described in the NZ Legislation Act 2019 Section 13 being a corporation sole, a body corporate and an unincorporated body, where there is no evidence that man is any of these; and
- To date, you have failed and/or refused to:
rebut the facts and evidence provided;
b. cure the default;
c. comply with your obligations to correct errors and misleading statements to remove actions of bad faith;
- Take notice that you are in default regarding the following matter(s):
a)Dealing in slaves, taking control over a man and making him a person and subject of the crown using prohibited actions of serfdom and debt bondage;
b)Perjury – fact, opinion, belief, or knowledge made by a witness in a judicial proceeding known to the witness to be false and being intended by him or her to mislead the proceeding, where the judge as man and counsel as man was witness in this proceeding;
c) Conspiring to bring false accusation, conspiring to defeat justice;
d) Threats and intimidation Crispin Vinnell and Diana Clare Matchett made threats on behalf of all respondents– judge told man Patrick to sit down and leave, obstructed from speaking when man has dominion in a matter that concerns him as well as threats to steal property that man holds full beneficial rights in his private trust;
e) Theft, including by deception and conversion by allowing the charge of person to be applied to man to steal from him;
f) Judge Dale Michael Lester dishonestly taking or using documents/property, reading from judgement document authored by himself dated 6 May 2026 and attempting to trick man :Patrick-James: into being the defendant;
g) False accounting, stating that because :Patrick-James: was served the high court documents, that he was then the defendant and required to pay sum declared by ASB BANK as he was the defendant, when man can never be a person or defendant;
h) Obtaining pecuniary gain by deception or causing loss by deception where both judge and counsel and directors and agents and employees ASB BANK being paid to use deception shows actions of bad faith removing private immunity;
i) Conspiracy to defraud; false statements by officers and agents and ASB BANK and judge making summary judgements claiming the man :Patrick-James: was the defendant PATRICK JAMES FOLEY so the man could be defrauded;
- That all of the above actions were done in bad faith and have removed private immunity of every single listed respondent. These actions are criminal in nature and chargeable offences. All the listed readers and respondents also become commercially liable for being complicit of enforcing a fraudulent debt upon man, making those parties liable to pay that same debt and for the debt claim against ASB BANK and ASB HOLDINGS in UCC filing claim 2025-288-2928-0 with name addition filing numbers 2026-243-2467-2 and 2026-243-2574-7. The commercial charge on this filing according to the compensation schedule in our Affidavit of Standing and Claim on the Land of Substance where the charges for unauthorised use of our copy righted trade names or obtaining or causing loss/harm by deception or Robbery/demand with intent to steal/harm are one million dollars per event or per day until remedied and one hundred and fifty million for any harm caused to us; The charges due to us the Secured Party Creditors and Claimants on fifteenth day of October 2025 is $281,981,154.35 in words being two hundred and eighty-one million, nine hundred and eighty-one thousand, one hundred and fifty-four new zealand dollars and thirty-six cents to be paid in 0.9999 gold bullion ten ounce bars or the ability to seize assets from the debtors until paid in full, with lawful right to add ten percent penalty interest per week until settled in full;
- An unrebutted undefended affidavit with evidence of truth and fact stands as truth in Commerce and judgement in Law in its entirety. It is also noted that in commerce, it is a felony for the Officer of a Political Party/Public Office to not receive and report a Claim to its Bonding Company – and it is a felony for the agent of a Bonding Company to not pay the Claim. If a Bonding Company does not get a malfeasant public official prosecuted for criminal malpractise within sixty (60) days, then it must pay the full face value of a defaulted Lien process (at 90 days). Except for a Jury, it is also a fatal offense for any person, even a judge, to impair or to expunge, without a Counter-Affidavit, any Affidavit or commercial process based upon an Affidavit. Judicial non-jury commercial judgements and orders originate from a limited liability entity called a municipal corporation – hence must be reinforced by a Commercial Affidavit and a Commercial Liability Bond. A foreclosure by a summary judgement (non-jury) without a commercial bond is a violation of commercial law; and
- That the default has been gazetted 1 September 2026 and on publicnoticesnz.com and in the newspaper with the following statement: “Formal Default NoticeTimaru and Christchurch High Court and all councils and banks now in default for charging man as person where only definition of person includes a corporation sole, a body corporate and an unincorporated body from legislation act 2019 section 13, where not one of these definitions cover a living man and any time man is charged as person the act of fraud has been committed. From 1 September 2026 any man acting as agent for any court or council or bank to collect a fraudulent debt is liable for the following charges: slavery, debt bondage and serfdom, obtaining gain or cause loss by deception with up to 14 years prison per event. It is also noted that all mortgages are fraudulent, and any bank or court or real estate agents and corporations or any type of debt collector involved in selling and/or seizure of property to collect fraudulent debt are now liable for criminal charges as well as one million dollar charge per day and per event.”
- This Notice serves as a final opportunity to take remedy.
You are hereby provided until 8 September 2026 to do the following:
a) Cure the default with settlement statement released by officers of ASB BANK showing nil balance with account settled in full, with all debt claim against PATRICK JAMES FOLEY and estate PATRICK JAMES FOLEY or against P.J. Foley or man commonly known as Pat or Patrick or Patrick-James cancelled and settled in full with promise of honour to not lay any further charges against PATRICK JAMES FOLEY or estate PATRICK JAMES FOLEY with settlement statement sent to [email protected] and hard copy to service address PO Box 9006 Greerton Tauranga 3142 by due date 8 September 2026;
b) That the mortgage instruments from ASB BANK be removed off property titles 665155 and 665156 with ASB BANK recognising in writing they hold no further claim against PATRICK JAMES FOLEY or property belonging to PATRICK JAMES FOLEY and provide unencumbered property titles by email to [email protected]; and
c) That the property listing for sale of 74 Frame Road Oamaru is removed and taken from the market for sale with confirmation provided in writing;
d) That the respondents arrange public notice in Otago Daily Times that “Patrick James Foley is no longer in receivership and debt settled in full and property 74 Frame Road Oamaru has been taken off the market”;
e) That PATRICK JAMES FOLEY and the estate PATRICK JAMES FOLEY is held in private trust and due to fraud being found in the mortgage and loan documents the debt claims of ASB BANK and ASB HOLDINGS are nil, where they provided no evidence that there ever was a debt, where money was created from the signature of man without his knowledge or consent, where no valid agency exists between any living being and any legal person held as Trust Property, No Settlor, Beneficiary, or Trustee has ever contracted to act as agent for any legal person is no signed contract that man ever agreed to be agent for the person PATRICK JAMES FOLEY, where the respondents confirm in writing that all current claims are settled in full against PATRICK JAMES FOLEY and that no future claims will be laid by any of the respondents;
f) That all respondents agree in writing that there will be no further harassment of man who lives on the land commonly known as 74 Frame Road Oamaru for the necessities of life and know that any further contact invokes immediate criminal charges for slavery, serfdom, debt slavery and obtaining by deception and causing loss of deception;
g) That if all of the contents for 9 a), b), c), d), e) and f) are actioned by 8 September 2026 Patrick-James as man will forgive all debtors and cancel the commercial liability and liens against all respondents and lien debtors;
h) That this Notice has been gazetted so no excuse for any parties not having knowledge of their liability or the final date for remedy offered with Crispin Vinnell also holding fiduciary duty to inform all parties.
